1. Agreement to these terms

These Terms of Use ("Terms") are a binding agreement between you and Be Wise, LLC ("More Epoxy Projects," "we," "us," or "our") governing your access to and use of moreepoxyprojects.com and our services (together, the "Service"). By accessing the Site, creating an account, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What we do

More Epoxy Projects helps epoxy flooring contractors grow by sourcing and qualifying property owners interested in epoxy work and presenting those project opportunities to contractors. Our automated assistant, "Flo," helps qualify enquiries and schedule work. We are a marketing and lead-generation service. We are not a party to, and are not responsible for, the contract or work performed between a contractor and a property owner.

3. Eligibility and accounts

You must be at least 18 and able to form a binding contract. If you register as a contractor, you agree to provide accurate information, keep it current, hold all licenses, permits, and insurance required for your trade and location, and keep your account credentials secure. You are responsible for activity under your account.

4. Projects, deposits, and fees

Where you accept a qualified project through the Service:

  • We may collect a deposit from the property owner to confirm a project. The deposit amount and whether it is refundable are disclosed at the time of booking.
  • You agree to pay More Epoxy Projects the fee or commission on closed, paid projects sourced through the Service, at the rate and on the payment terms presented to and accepted by you when you sign up or accept a project. Those rates and terms form part of this agreement.
  • You agree not to circumvent the Service to avoid fees on opportunities first introduced to you through the Service, for the period stated in your sign-up terms.

5. No guarantee

We do not guarantee any specific number, quality, value, or conversion rate of leads or projects, or any particular result or revenue. Project opportunities are provided on an as-available basis.

6. Contractor responsibilities

You are solely responsible for the work you perform, including quality, safety, warranties, pricing, permits, and compliance with law, and for your communications and dealings with property owners. You will treat customer information consistent with applicable law and our Privacy Policy.

7. Acceptable use

You agree not to misuse the Service, including: violating law; infringing others' rights; submitting false information; interfering with or attempting to gain unauthorized access to the Service; scraping or harvesting data; or using the Service to send spam or harass others.

8. Intellectual property

The Site, the Service, and all related content, trademarks, and software are owned by Be Wise, LLC or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You retain rights to content you submit, and grant us a license to use it to operate and improve the Service.

9. Third-party services and links

The Service relies on and may link to third-party services (for example, Stripe for payment processing). We are not responsible for third-party services, and your use of them may be subject to their own terms.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BE WISE, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE TOTAL AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Be Wise, LLC and its officers, members, employees, and agents from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Service; (b) the work, services, or products you provide to, or your dealings with, property owners or any other third party; (c) any act, omission, statement, representation, or misrepresentation made by you — including any claim, promise, or representation you make to a property owner or other third party regarding pricing, scope, quality, timelines, warranties, or the involvement, endorsement, or responsibility of More Epoxy Projects or Be Wise, LLC; (d) your violation of any law or the rights of any third party; or (e) your breach of these Terms.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or for other legitimate operational reasons. Provisions that by their nature should survive termination will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute will be the state and federal courts located in Middlesex County, New Jersey, and you consent to their jurisdiction.

15. Changes to these terms

We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date, and material changes take effect when posted or as otherwise stated. Continued use means you accept the updated Terms.
