Terms of Service

Agreement to Terms

These Terms of Service ("Terms") govern your use of the MoreEpoxy platform at moreepoxyprojects.com ("Platform"), operated by MoreEpoxy ("we," "us," or "our"). By registering for an account or using our services, you agree to be bound by these Terms.

If you are registering on behalf of a business, you represent that you have authority to bind that business to these Terms.

The Service

MoreEpoxy provides a marketplace platform that connects epoxy flooring and garage-floor-coating contractors ("Contractors") with potential customers ("Leads"). We facilitate introductions but are not a party to any agreement between Contractors and their customers.

We do not guarantee any minimum number of leads, conversion rates, or revenue. Lead volume depends on customer demand in your service area.

Account Registration

To use our Platform as a Contractor, you must:

  • Provide accurate and complete registration information
  • Maintain valid business licenses and insurance as required by your jurisdiction
  • Keep your account credentials secure
  • Notify us immediately of any unauthorized account access
  • Be at least 18 years old

You are responsible for all activity under your account.

Leads and Payment

Our Platform operates on a pay-per-lead model:

  • You pay for leads delivered to you based on your selected service area and categories
  • Lead pricing is displayed before you accept leads
  • Payment is due upon lead delivery, charged to your payment method on file
  • Refunds for invalid leads (wrong contact info, outside service area, duplicates) must be requested within 7 days

We reserve the right to modify pricing with 30 days notice. Continued use after pricing changes constitutes acceptance.

Contractor Obligations

As a Contractor on our Platform, you agree to:

  • Respond to leads promptly and professionally
  • Provide accurate information about your services and pricing
  • Maintain appropriate licenses, insurance, and certifications
  • Deliver quality work that meets industry standards
  • Handle customer disputes directly and professionally
  • Not circumvent the Platform to avoid lead fees
  • Not use leads for purposes other than providing epoxy/coating services

Prohibited Conduct

You may not:

  • Provide false or misleading information
  • Engage in fraudulent or deceptive practices
  • Harass, spam, or abuse customers or other users
  • Violate any applicable laws or regulations
  • Attempt to reverse-engineer or interfere with the Platform
  • Share or resell leads
  • Use automated systems to access the Platform without permission

Intellectual Property

The Platform, including its design, features, and content, is owned by MoreEpoxy and protected by intellectual property laws. You may not copy, modify, or distribute our materials without permission.

Content you submit (business descriptions, photos, etc.) remains yours, but you grant us a license to use it on the Platform and in marketing materials.

Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • Uninterrupted or error-free service
  • That leads will result in sales or revenue
  • The accuracy of information provided by customers
  • The conduct or quality of work by other Contractors

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOREEPOXY SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Lost profits, revenue, or business opportunities
  • Damages arising from customer disputes

Our total liability shall not exceed the fees you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold MoreEpoxy harmless from claims, damages, and expenses (including attorney fees) arising from your use of the Platform, your services to customers, or your violation of these Terms.

Termination

You may close your account at any time by contacting us. We may suspend or terminate your account for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Extended inactivity
  • Any reason with 30 days notice

Upon termination, you remain responsible for outstanding payments. Provisions that should survive termination (intellectual property, limitations of liability, indemnification) will continue in effect.

Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to participate in class actions.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Platform. Continued use after changes constitutes acceptance of the updated Terms.

Text Messages (SMS)

MoreEpoxyProjects sends account and job-related text messages to contractors who opt in — for example that a job has been assigned to you, that a quote is ready, or a scheduling update. We do not send marketing or promotional text messages under this program.

Consent is optional and is never a condition of using the Service. You give it by ticking the text-message box next to your mobile number when you sign up or on your profile, and you can withdraw it at any time by clearing that box or by replying STOP to any message. Reply HELP for help.

Message frequency varies with your job activity. Msg & data rates may apply. Carriers are not liable for delayed or undelivered messages. Your mobile number, opt-in and consent information are handled as described in our Privacy Policy, and are never shared or sold to third parties or affiliates for their own marketing purposes.
